Should I Hire a Public Defender or a Private Attorney for a DUI Charge in Arizona?
One of the most common questions we get from people facing DUI charges in Arizona is whether they should hire a private attorney or use a public defender.
And honestly, it’s a fair question.
DUI cases are expensive. There’s no way around that. Between court fines, alcohol screenings, treatment classes, ignition interlock devices, increased insurance rates, and all of the other costs that come along with a DUI conviction, we’ve done an analysis and we believe the total financial impact of a DUI is probably somewhere between $12,000 and $16,000 over the next three years.
So when people call our office and they’re already worried about money, we understand why they’re asking whether they really need to hire a private attorney.
The Cost of a DUI in Arizona
A lot of people initially focus only on attorney’s fees, but that’s actually just one piece of the equation.
A DUI conviction in Arizona can involve:

Can You Get a Public Defender for a DUI in Arizona?
Yes.
In Arizona, if you cannot afford an attorney, the court may appoint a public defender or court-appointed attorney after determining eligibility under A.R.S. § 11-584 and Rule 6.1 of the Arizona Rules of Criminal Procedure.
So if somebody truly cannot afford legal representation, there are protections in place to make sure they still have access to counsel.
Are Public Defenders Good Lawyers?
We have absolutely nothing bad to say about public defenders.
A lot of them are very good lawyers. Many of them have handled an enormous number of cases, they know the court system very well, and they genuinely care about the people they represent.
The issue is usually not competence. The issue is volume.
The Biggest Difference: Case Volume and Time
Public defenders and court-appointed lawyers are often handling extremely large caseloads.
They may have contracts with courts or cities that require them to manage a very high number of criminal cases at one time. Because of that, it can be difficult to give every client the level of time, attention, and scrutiny that a DUI case sometimes requires.
DUI cases are technical cases.
There are:
- Blood test issues
- Breath test issues
- Police reports
- Bodycam footage
- Dashcam footage
- Calibration records
- Traffic stop legality questions
- Field sobriety testing issues
These cases can require a tremendous amount of review and preparation.

Is a Public Defender Better Than Representing Yourself?
Absolutely.
If somebody is considering representing themselves because they cannot afford a private attorney, we would strongly encourage them to seek representation from a public defender or court-appointed attorney instead.
Even with the limitations that come from heavy caseloads, having trained legal counsel is almost always better than trying to navigate a DUI case alone.
